It’s an accident involving a worker when traveling to or from work.
Pursuant to the Law, one of these four requirements must be met in order for such an accident to be considered a commuting accident:
- Intent: The purpose of the travel must be to go to or return from work.
- Topographic: The road used for the travel must be the one habitually and normally used.
- Mechanical: The means of transport used must be habitual and appropriate for the distance to be travelled.
- Chronological: The time used must be considered normal, without any interruptions for personal reasons that may break the relationship of causality and considering the distance to be travelled, the means of transport used, etc.
