The doctor issuing the leave, confirmation and fit to work reports gives the worker two copies, one for the interested party and the other for the company.
The worker must deliver one of the copies of the leave and confirmation reports to the company within 3 days.
If the worker’s employment contract has already ended, it should be submitted to the mutual insurance company. The professional contingency report is not necessary as it is issued by the mutual insurance company itself.
Within 24 hours following issuance of the fit to work report, the worker must give a copy to the company or the mutual insurance company in cases where the contract has ended. For professional contingencies, this is not necessary as it is issued by the mutual insurance company itself.
The Spanish Public Health Service (for common contingencies) or, as applicable, the mutual insurance company (for professional contingencies) will send leave, confirmation and fit to work reports to INSS (Spanish National Social Security Institute) electronically immediately and on the first business day following issuance.
Within a maximum of 3 business days after receiving the reports submitted by workers, the company must send leave, confirmation and fit to work reports to INSS (Spanish National Social Security Institute) via the RED system.
A failure to complete this procedure may be considered a minor offence with a 60 to 625 euro fine.
